Judge Petria McDonnell stated that the Burkes’ claims were ‘moot’ last June

The Burkes’ appeal against Judge Petria McDonnell’s refusal to recuse herself from hearing their case against NUI Galway will be heard by the High Court on Monday 17 February 2020 sitting at the Courthouse, Washington Street, Cork.

The Burkes appealed to the High Court in June last year after Judge Petria McDonnell refused to recuse herself from hearing their case. Their Equal Status case against NUI Galway is currently stayed pending the outcome of this High Court application.

Judge McDonnell stated that the Burkes’ religious discrimination claims were “moot” (irrelevant and unnecessary) at the outset of a Circuit Court hearing in Galway on 18 June 2019.

In a joint statement released 15 February 2020 in advance of the hearing, Isaac Burke, Kezia Burke, Enoch Burke and Ammi Burke said:

“This is an extremely important matter – not just for us, in our case, but indeed for everyone who values a fair and impartial judicial system. We all have the right to a fair and impartial hearing. That right must be protected and preserved.”
