Isaac Burke won damages over an delay in scheduling his PhD viva examination

On Thursday 16 January 2020, Galway Circuit Court awarded damages of €13,035 against the University. Isaac Burke responds to the outcome of the case.

“I submitted my thesis in January 2017. University Guidelines and Regulations state that the viva exam “should normally be held within two months of the submission of the thesis.”

“By October 2017, the University had not scheduled a viva exam for me. All my efforts to get the University to organise one were unsuccessful.

“I had no option but to commence court proceedings against NUI Galway for negligence and breach of contract. That was in late 2017. On Thursday this week, the action came for hearing at Galway Circuit Court.

“The Court ruled in my favour, finding that NUI Galway had acted unlawfully and that I had suffered as a result.

“It has been a difficult three years and I am thankful for the support of my family throughout this time. I look forward now to taking my viva exam, obtaining my doctorate, and moving on.”
